These Terms of Service ("Terms") govern your use of thegroovemedia.com and the services provided by The Groove Media ("we," "us," or "our"). By using our Site or services, you agree to these Terms.

1. Services

The Groove Media provides contractor lead generation services including AI-powered call answering, automated follow-up, CRM management, and website services for contractors and home service businesses.

2. Client Obligations

As a client, you agree to:

• Provide accurate and complete information during onboarding
• Use our services only for lawful business purposes
• Not misuse or attempt to circumvent our systems
• Notify us promptly of any changes to your business information

3. Payment Terms

Services are billed monthly. Setup fees are due at the time of onboarding. Monthly fees are due on the same date each month. We reserve the right to suspend services for non-payment after 7 days notice.

4. Cancellation

You may cancel your monthly service at any time with no penalty. Cancellation takes effect at the end of the current billing period. Setup fees are non-refundable. We offer a 30-day money-back guarantee on monthly fees if you are not satisfied with the results.

5. SMS Messaging Program

By providing your phone number and submitting our contact form, calling our AI receptionist, or purchasing a service from The Groove Media, you consent to receive transactional SMS messages from The Groove Media.

Program description: Our SMS program sends lead capture confirmations, appointment booking confirmations and reminders, automated follow-up messages to inbound leads, and service onboarding communications.

• Opt-out: Reply STOP to any message to unsubscribe at any time. You will receive a confirmation and no further messages will be sent.
• Help: Reply HELP to any message for assistance, or contact us at stephen@thegroovemedia.com or (240) 221-6089.
• Message frequency: Varies based on your service level and activity. Typically 1–5 messages per interaction.
• Message & data rates: Standard message and data rates may apply depending on your mobile carrier plan.
• Carrier liability: Carriers are not liable for delayed or undelivered messages.
• Age restriction: You must be 18 years of age or older to consent to receive SMS communications from The Groove Media.

6. AI Voice Assistant

Our AI voice assistant collects caller information on behalf of our clients. Calls may be recorded and transcribed for quality assurance and lead management purposes. Callers are informed they are speaking with an AI assistant.

7. Intellectual Property

All content on thegroovemedia.com is owned by The Groove Media. Client websites built by us remain the property of the client upon full payment. Our underlying systems, workflows, and automation frameworks remain our intellectual property.

8. Limitation of Liability

The Groove Media shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

9. Disclaimer

We do not guarantee specific lead volumes or revenue outcomes. Results vary based on market conditions, trade type, service area, and other factors outside our control. We commit to providing the services as described and optimizing performance on your behalf.

10. Governing Law

These Terms are governed by the laws of the State of Maryland. Any disputes shall be resolved in the courts of Prince George's County, Maryland.

11. Changes to Terms

We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
